TERMS & CONDITIONS / RENTAL AGREEMENT

These Terms and Conditions Agreement (“Agreement”) governs all photo booth rentals provided by Desert Clicksy Studio (“Company,” “We,” “Us,” or “Our”) to the customer (“Customer,” “Client,” “You,” or “Your”).

By booking our services, paying a retainer, or allowing guests to use our equipment, you confirm that you have read, understood, and agree to be legally bound by this Agreement.

1. RENTAL PERIOD

  • Rental period begins at the agreed start time and ends at the agreed end time listed in your booking confirmation.
  • Additional hours beyond the contracted time will incur extra charges.
  • Children must be supervised at all times while using the booth.
  • The photo booth cannot be moved once set up (see Section 11).

2. BOOKING & PAYMENT

  • A non-refundable 30% retainer is required to secure your date.
  • Remaining balance is due 14 days before the event.
  • Bookings are confirmed only once the retainer is received and a written confirmation is issued.
  • Returned checks incur a $35 fee.

3. CANCELLATIONS

Customer Cancellation

  • 14+ days before the event: All payments refunded except the retainer.
  • Within 14 days: All payments are non-refundable.
  • Partial refunds may be considered at the Company’s discretion.

Company Cancellation

  • If Desert Clicksy Studio must cancel due to illness, emergency, weather, or unforeseen circumstances, the Client will receive a full refund of all payments made.
  • Liability is limited solely to the amount paid.

4. RESCHEDULING POLICY

  • Rescheduling is subject to availability.
  • If the new date is unavailable, the cancellation policy (Section 3) applies.

Weather / Health Rescheduling

If the event must be canceled or postponed due to:

  • Severe weather
  • Emergency
  • Medical/health issues

The Client may reschedule one (1) time within 12 months, based on availability.

No refunds are issued for these cancellations.

5. EQUIPMENT USE

  • Equipment must be used only as instructed.
  • Client is responsible for:
  • Misuse
  • Negligence
  • Intentional damage
  • Client must pay repair, replacement, or service-interruption fees if damage occurs.

6. TECHNICAL ISSUES

  • In the event of a technical malfunction, liability is limited to a partial refund based on downtime.
  • No refunds for issues caused by venue limitations, including:
  • Insufficient power
  • Poor Wi-Fi
  • Signal interference
  • Environmental restrictions
  • Paper/ribbon changes under 20 minutes will be added back to your rental time.

7. VENUE SETUP REQUIREMENTS

Space Requirements

  • 20 ft wide wall space
  • 8 ft minimum ceiling height
  • 20 ft open floor area for booth, backdrop, props, and guest flow

Power Requirements

  • Working 110V outlet within 15 ft of the setup area.

Outdoor Events

Client must provide:

  • A 12x12 canopy or fully shaded area (mandatory)
  • Flat, stable ground (cement, concrete, or level grass)
  • Power outlet or rent a Company power bank

8. LIABILITY & INDEMNITY

  • The Company is not liable for injuries, property damage, accidents or incidents involving:
  • Guests
  • Venue conditions
  • Props or equipment
  • Client is responsible for guest behavior and all incidents, including slip-and-falls.
  • Client agrees to indemnify and hold harmless Desert Clicksy Studio and its staff from any claims arising during the event.

9. INTELLECTUAL PROPERTY

Client Photo Rights

  • Client has personal-use rights to all photos from the event.

Company Property

  • All templates, layouts, software, booth designs, and digital content remain exclusive property of Desert Clicksy Studio.

Marketing Permission

  • Company may use selected event images for advertising unless declined in writing before the event.

10. PHOTO QUALITY DISCLOSURE

Minimum Distance

Guests must stand at least 5 ft from the camera/backdrop to prevent:

  • Blurriness
  • Distortion
  • Cropping
  • Loss of detail

Environmental Factors Affecting Photo Quality

Lighting conditions may cause:

  • Overexposure/underexposure
  • Shadows
  • Glare
  • Grain/noise
  • Light streaks

External flashes or other cameras may cause:

  • Washed-out faces
  • Color distortion
  • White-out glare

No Photo Guarantee

The Company cannot guarantee perfect or studio-grade photo quality if venue lighting or environmental conditions interfere.

11. DISCLAIMERS

Photo quality may be affected by:

  • Low lighting
  • Disco or colored party lights
  • Shadows/backlighting
  • LED/neon signage
  • Mixed lighting
  • Other camera flashes

Desert Clicksy Studio does not guarantee studio-grade image quality in such conditions.

12. EQUIPMENT PLACEMENT & MOVEMENT POLICY

  • Booth must remain in the exact location where the Company sets it up.
  • Equipment may not be moved by:
  • Client
  • Guests
  • Venue staff
  • DJs
  • Decorators
  • Photographers
  • Unauthorized movement may result in:
  • Immediate suspension of service
  • Damage fees
  • Termination with no refund
  • Additional penalty fee: $500

13. OUTDOOR SETUP REQUIREMENTS

To protect equipment:

Shaded / Covered Area

  • Booth must remain fully shaded.
  • Direct sun exposure is prohibited.

Surface Requirements

  • Level cement, concrete, flooring, or grass.
  • No slopes, sand, gravel, or uneven ground.

Weather Protection

  • The company may pause or stop service due to unsafe conditions (heat, wind, dust, rain).
  • No refunds for weather-related interruptions.

Optional Rentals

  • Canopy / Tent: $95
  • Power Bank / Generator: $75

14. MEDIA RELEASE & MARKETING CONSENT

1. Use of Photos & Videos

Desert Clicksy Studio may use event photos, videos, GIFs, and boomerangs for:

  • Marketing
  • Social media
  • Website galleries
  • Print materials
  • Advertising
  • Portfolios

All digital content produced remains Company intellectual property.

2. Host Responsibility

Client must inform all guests, including parents of minors, that photos may be used for marketing.

3. Minors

Children under 18 must be supervised.

Parents may opt-out by written request before the event.

4. OPT-OUT OPTION: If you DO NOT want your images used: You MUST notify us in writing within 24 hours at DesertClicksy@gmail.com. If we do not receive your written decline within 24 hours, we will assume you authorize marketing use.

5. Copyright

Clients may not sell, alter, or use images for commercial purposes without written permission.

6. No Compensation

Guests and clients will not receive compensation for marketing use of images.

15. LOAD-IN, LOAD-OUT & EQUIPMENT HANDLING

Load-In/Load-Out Access

Client must provide:

  • A safe, accessible unloading/loading area close to setup.

Accessibility Requirements

Client must notify the Company if setup involves:

  • Stairs
  • Upper floors
  • Basements
  • Narrow hallways
  • Long walking distances
  • Steep ramps
  • No elevator access
  • Uneven terrain

Additional Handling Fee

  • Standard fee: $100
  • Additional fees may apply depending on difficulty.

Assistance Requirements

If setup requires manual lifting or stairs:

  • Client must provide onsite assistance OR
  • Approve additional labor fees.

Failure to Provide Safe Access

The Company may:

  • Change the setup location, or
  • Refuse service with no refund.

AGREEMENT ACKNOWLEDGMENT

By booking Desert Clicksy Studio Photo Booth, the Client confirms they have read, understood, and agree to all terms within this Agreement.
